medio de comunicaci\u00f3n, el presidente de Ecopetrol ha recibido por parte de la Procuradur\u00eda desde el mes de Julio varios llamados y aunque se acataron algunos puntos, Ecopetrol se escuda en la reserva de informaci\u00f3n para dar a conocer c\u00f3mo va el proceso. De acuerdo con las investigaciones y lo que ha salido en los medios, Ecopetrol dice <em>\u201cque es un modelo de contrataci\u00f3n privado, por eso su presidente y asesores, omitieron subir a la plataforma p\u00fablica SECOP II, varios documentos del proceso\u201d<\/em>.<\/p>\n<p><em>\u201cSomos parte de un proceso que como lo dicen las propias autoridades, ha estado viciado y no ha permitido durante m\u00e1s de una d\u00e9cada y media, que nadie participe en este proceso, es decir, lo \u00fanico que como empresa del sector y oferentes pedimos, es que sea un proceso transparente, con las cartas sobre la mesa\u201d,<\/em> coment\u00f3 Restrepo Botero.<\/p>\n<p>La compa\u00f1\u00eda present\u00f3 una oferta que se ajusta de acuerdo con las reglas de participaci\u00f3n y con altos est\u00e1ndares de competencia en seguridad y econ\u00f3mica, desde los inicios ha atendido todos los requerimientos de Ecopetrol, pero a la fecha y seg\u00fan las declaraciones del mismo CEO, sigue sin saber el estado de su oferta y evaluaci\u00f3n. El d\u00eda de hoy de forma inexplicable se conoci\u00f3 a trav\u00e9s de medios de comunicaci\u00f3n que Ecopetrol se escuda en un r\u00e9gimen de derecho privado para no brindar ning\u00fan tipo de informaci\u00f3n y\/o explicaci\u00f3n, en el desaf\u00edo de los principales rectores de la fundaci\u00f3n administrativa, los cuales son se\u00f1alados en el ART 209 de la Constituci\u00f3n Pol\u00edtica Colombiana, que son los aplicables al proceso, poniendo as\u00ed en riesgo los derechos fundamentales que le asisten a Helicol y dem\u00e1s oferentes; en casos similares han sido protegidos por la Corte Constitucional de acuerdo con la sentencia T 1029 de 2005 y desatendiendo solicitudes de la Procuradur\u00eda General de la Naci\u00f3n que lo ha instado a honrar los principios de transparencia y contradicci\u00f3n.<\/p>\n<p><em>\u201cEstamos hablando de uno de los procesos m\u00e1s grandes de la historia en el mercado helicoportado desde 1955, contribuyendo al desarrollo de la infraestructura petrolera en el pa\u00eds y con los m\u00e1s altos est\u00e1ndares de seguridad y transparencia. Pero, como he comentado en algunas entrevistas pasadas, ya algunas empresas han tenido que cerrar por culpa de la competencia sin garant\u00edas en los procesos licitatorios\u201d,<\/em> finaliz\u00f3
