medidas cautelares con el fin de proteger al usuario. <\/em><\/strong><\/h5><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e4cacc8 elementor-widget elementor-widget-text-editor\" data-id=\"e4cacc8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\"><p>El 1 de septiembre de 2023 la Superintendencia de Industria y Comercio (SIC) decret\u00f3 medidas cautelares en contra de LATAM por actos de competencia desleal consistentes en publicar, comercializar y operar vuelos desde y hacia Bogot\u00e1 sin contar con autorizaci\u00f3n (slots).<\/p>\n<p>Ante la solicitud de apelaci\u00f3n presentada por LATAM en contra de dicha decisi\u00f3n, el Tribunal Superior de Bogot\u00e1, confirm\u00f3 la legitimidad y necesidad de las medidas cautelares en contra de LATAM. De hecho, el Tribunal trascribi\u00f3 el an\u00e1lisis que efectu\u00f3 la SIC:<\/p>\n<p><em>\u201c\u2026 [LATAM] realiz\u00f3 oferta de vuelos que alcanzan operaciones en marzo de 2024 sin slots, de tal suerte que con el paso del tiempo la accionada se asegura un incremento de ventas en su operaci\u00f3n no autorizada para al menos 4.862 vuelos, cifra que seguir\u00e1 en aumento de no adoptar las medidas necesarias que garanticen que sus actuaciones se ajusten al marco normativo que se acredita como vulnerado<\/em><sup>1<\/sup>.<\/p>\n<p>A pesar de lo anterior, el Tribunal concluy\u00f3 que la SIC omiti\u00f3 profundizar en si las medidas cautelares decretadas eran efectivas y proporcionales a la deslealtad del acto de LATAM, motivo por el cual procedi\u00f3 a revocar las mismas. Por tanto, Avianca solicitar\u00e1 a las autoridades judiciales que se realice el an\u00e1lisis &#8211; que a juicio del Tribunal est\u00e1 incompleto &#8211; para evitar que por un aspecto meramente procesal se deje de proteger al mercado y a los consumidores frente a los actos competencia desleal de LATAM.<\/p>\n<p>Avianca cree firmemente que las reglas son para todos y que la violaci\u00f3n de las normas por parte de LATAM est\u00e1 suficientemente probada. La compa\u00f1\u00eda conf\u00eda en que estas medidas, que protegen tanto al mercado como pasajeros y que fueron revocadas por un aspecto meramente formal, sean prontamente restauradas.<\/p>\n<p>Finalmente, la compa\u00f1\u00eda reitera que su \u00fanico objetivo es solicitar el estricto cumplimiento de la ley, y evitar que se efect\u00faen pr\u00e1cticas de competencia
