Quiebras de los Estados Unidos, el d\u00eda 24\u00a0 de abril de 2022 present\u00f3 ante dicha Corte, un Plan de Reorganizaci\u00f3n modificado (el \u201c<u>Plan de Reorganizaci\u00f3n\u201d o el \u201cPlan <\/u>\u201d) y LATAM y las dem\u00e1s partes que le han suscrito se encuentran en el proceso de completar la suscripci\u00f3n de una modificaci\u00f3n al Acuerdo de Apoyo a la Reestructuraci\u00f3n (el \u201c<u>RSA<\/u>\u201d) celebrado por ellos\u00a0 en el marco del Plan, que ser\u00e1 presentando ante la Corte una vez suscrito por todas sus partes, lo que se espera ocurra en un d\u00eda o dos.<\/p>\n<p>El objetivo de estas modificaciones al Plan y al RSA es modificar el tratamiento otorgado a los cr\u00e9ditos (los \u201c<u>Cr\u00e9ditos RCF<\/u>\u201d) relacionados con el contrato de cr\u00e9dito y garant\u00eda de fecha 29 de marzo de 2016 (el \u201c<u>Contrato de Cr\u00e9dito RCF<\/u>\u201d). Las versiones anteriores del Plan establec\u00edan que los Cr\u00e9ditos RCF no se ve\u00edan afectados y, por lo tanto, se presum\u00eda que aceptaban el Plan (por lo que no era necesario solicitar sus votos). El tratamiento anterior se propuso en el entendimiento de que los Cr\u00e9ditos RCF se refinanciar\u00edan en virtud de un Contrato de Cr\u00e9dito RCF reestructurado (el \u201c<u>Contrato de Cr\u00e9dito Reestructurado<\/u>\u201d), o de otro modo bajo Plan. La modificaci\u00f3n del Plan no afecta a ninguna otra clase de cr\u00e9ditos.<\/p>\n<p>Dado que algunos pocos de los titulares de los Cr\u00e9ditos RCF y otras potenciales fuentes de financiamiento no est\u00e1n actualmente en posici\u00f3n de proporcionar, en la cantidad y estructura que se hab\u00eda contemplado, el financiamiento necesario bajo el Contrato de Cr\u00e9dito RCF Reestructurado, LATAM ha tenido la necesidad de modificar el tratamiento de los Cr\u00e9ditos RCF en el Plan para establecer que dichos cr\u00e9ditos ahora son afectados por el Plan y, por lo tanto, tienen derecho a votar para aceptar o rechazar el Plan. La modificaci\u00f3n establece adem\u00e1s que cada titular de Cr\u00e9ditos RCF tendr\u00e1 derecho a elegir entre dos tratamientos diferentes, dependiendo de si est\u00e1 o no dispuesto a proporcionar compromisos de financiamiento para el Contrato de Cr\u00e9dito RCF Reestructurado. Los titulares de los Cr\u00e9ditos RCF que asuman compromisos de financiamiento recibir\u00e1n el Tratamiento Clase 1a, mientras que los titulares de los Cr\u00e9ditos RCF que no asuman compromisos de financiamiento, as\u00ed como los que no hagan ninguna elecci\u00f3n, recibir\u00e1n el Tratamiento Clase 1b.<\/p>\n<p>De acuerdo con esta estructura, el importe total del Contrato de Cr\u00e9dito RCF Reestructurado ser\u00eda de US$600 millones y consistir\u00e1 en una combinaci\u00f3n de un Financiamiento Tramo A y un Financiamiento Tramo B en una proporci\u00f3n que se determinar\u00e1 en funci\u00f3n de las elecciones que efect\u00faen los titulares de los Cr\u00e9ditos RCF. Los pr\u00e9stamos bajo el Financiamiento Tramo B estar\u00e1n subordinados al pago a los pr\u00e9stamos bajo Financiamiento Tramo A.<\/p>\n<p>El Financiamiento Tramo A se reservar\u00e1 para los titulares de los Cr\u00e9ditos RCF que elijan el Tratamiento Clase 1a. Este financiamiento consistir\u00e1 en una nueva l\u00ednea de cr\u00e9dito rotativa que no ser\u00e1 desembolsada a la fecha efectiva del Plan. El Financiamiento Tramo A tendr\u00e1 una fecha de vencimiento de tres a\u00f1os y devengar\u00e1 intereses al SOFR + 3% anual, los cuales podr\u00e1n ser pagados en forma mensual, trimestral o semestral. De acuerdo con el Plan modificado, cada titular de los Cr\u00e9ditos RCF que elija el Tratamiento de Clase 1a recibir\u00e1 tambi\u00e9n una distribuci\u00f3n en efectivo igual al importe de capital pendiente de pago en virtud del Contrato de Cr\u00e9dito RCF, m\u00e1s los respectivos intereses, comisiones y gastos no pagados que componen el importe permitido de dicho Cr\u00e9dito RCF (en la medida en que no haya sido pagado previamente por LATAM).<\/p>\n<p>A su vez, el Financiamiento Tramo B estar\u00e1 reservado a los titulares de los Cr\u00e9ditos RCF que elijan el Tratamiento Clase 1b, as\u00ed como a los titulares que no hagan ninguna elecci\u00f3n. Dicho financiamiento servir\u00e1 para refinanciar (en forma de <em>take-back debt<\/em>) el importe de capital pendiente de pago bajo sus respectivos Cr\u00e9ditos RCF. El Financiamiento Tramo B tendr\u00e1 una fecha de vencimiento de cinco a\u00f1os y devengar\u00e1 intereses a una tasa fija del 4,25% anual, los cuales ser\u00e1n pagados en forma trimestral. De acuerdo con el Plan modificado, cada titular de los Cr\u00e9ditos RCF que reciba el Tratamiento Clase 1b tambi\u00e9n recibir\u00e1 una distribuci\u00f3n en efectivo igual a los intereses, comisiones y gastos no pagados que componen el importe permitido de sus respectivos Cr\u00e9ditos RCF (en la medida en que no hayan sido pagados previamente por LATAM).<\/p>\n<p><strong>Prensa LATAM
